These Terms of Use ("Terms") govern your access to and use of the website located at www.justthetipcigars.com, together with any related, staging, preview, or successor domain we use to operate the site, including dptgw.club while the site is in development, operated by Just The Tip Cigars ("JTTC," "we," "us," or "our"). By using the site, you agree to these Terms. If you do not agree, please do not use the site.

You must be at least 21 years old to use this site. An age gate appears on first visit; entering confirms you meet the minimum age requirement. The age gate is access control, not a substitute for purchase-time age verification. We may require additional age verification for any tobacco-related transaction. See our Privacy Policy for more on how we handle age verification.

Aficionado's Corner is an optional account that lets you keep a personal cigar journal, humidor, ashtray, wishlist, pipe collection, and view your in-store purchase history when your account is matched to our records.

When you create an account you agree to:

• Provide accurate information and keep it current.
• Maintain the confidentiality of your password and any session credentials.
• Take responsibility for activity that occurs under your account.
• Notify us promptly if you suspect unauthorized access.

Accounts are for individual use. Do not share login credentials. You can close your account at any time by emailing us.

You agree not to:

• Use the site for any unlawful purpose or in violation of any applicable law or regulation.
• Misrepresent your age, identity, or affiliation with any person or organization.
• Attempt to gain unauthorized access to any account, system, or data.
• Interfere with, disrupt, or place an unreasonable load on the site or its infrastructure (including automated scraping, crawling, or scanning beyond what our robots.txt permits).
• Upload or transmit content that is illegal, infringing, defamatory, harassing, sexually explicit, hateful, or that contains malicious code.
• Use the site to send unsolicited commercial messages or to harvest contact information from other users.
• Reverse engineer, decompile, or attempt to derive source code from the site, except where applicable law expressly permits.
• Resell, rent, or commercially exploit any part of the site without our written permission.

Your account may include content you create or upload — cigar tasting notes, ratings, journal entries, humidor and wishlist data, and photos of cigar bands, pipes, or your avatar (collectively, "Your Content").

You retain ownership of Your Content. By submitting Your Content to the site, you grant JTTC a limited, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating your account and providing the features you use. We do not use Your Content for marketing, training, or third-party purposes.

You represent and warrant that you have the right to upload Your Content and that it does not infringe anyone's rights or violate any law. If we believe content violates these Terms, we may remove it or suspend the account.

The site's design, layout, written copy, photographs, logos, and branding are owned by JTTC or licensed to us, and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, redistribute, or create derivative works from our content without written permission, except for ordinary personal browsing.

Product names, brand logos, and trademarks of cigar manufacturers and other third parties shown on the site remain the property of their respective owners. Their appearance on the site does not imply sponsorship or endorsement of JTTC by those owners unless explicitly stated.

The site uses third-party services to operate — including Supabase for authentication, database, and storage; Vercel for hosting; Lightspeed Retail X-Series for product and customer-data source; Upstash for caching; and Google Maps for the embedded map. These providers may process information as described in our Privacy Policy. We are not responsible for the practices, terms, or content of third-party websites or services linked from or embedded in the site.

Product listings on the site are for browsing and information purposes. Inventory, prices, descriptions, and availability come from our point-of-sale system and may change at any time without notice. Listing a product on the site is not an offer to sell at a particular price and does not guarantee availability. The site does not currently provide online checkout or online payment processing, and any cart, wishlist, or product-saving features do not create a completed sale. All tobacco sales take place in our physical store and are governed by our in-store policies, age-verification procedures, tobacco sales rules, and applicable law.

The site is provided "as is" and "as available." To the fullest extent permitted by law, JTTC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. Cigar descriptions, tasting notes, and similar content reflect general guidance and may not describe every variant. We do not warrant that the site will be error-free or secure, or that any defect will be corrected.

To the fullest extent permitted by law, JTTC and its owners, employees, and vendors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the site, including loss of data, loss of business, or loss of goodwill, even if advised of the possibility of such damages. Our total liability for any claim arising under these Terms will not exceed one hundred U.S. dollars (USD 100). Some jurisdictions do not allow certain limitations, so the above may not fully apply to you.

You agree to indemnify and hold harmless JTTC and its owners, employees, and vendors from any claim or demand, including reasonable attorneys' fees, arising out of your use of the site, your violation of these Terms, or your violation of any law or third-party right.

We may suspend or terminate your access to the site or your account at any time if we believe you have violated these Terms or applicable law, or if continuing to provide access would expose JTTC, our customers, or third parties to risk. You can stop using the site at any time and close your account by emailing us.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or your use of the site shall be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to personal jurisdiction in those courts.

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify account holders by email or with a banner on the site. Continued use of the site after changes take effect constitutes acceptance of the revised Terms.
